Welcome to FollowUpX. By registering an account, accessing our dashboard, or using our WhatsApp follow-up automation software ("Services"), you agree to be bound by these Terms of Service. Please read them thoroughly before proceeding.
1. Account Registration & Eligibility
Requirements for creating and maintaining an active merchant account
To use FollowUpX, you must be at least 18 years of age and legally capable of entering into binding contracts. When registering via our passwordless magic link or email authentication:
- You must provide accurate, current, and verifiable business and contact details.
- You are responsible for safeguarding your registered email and authorized session devices.
- You must immediately notify FollowUpX support of any unauthorized account access or security breach.
2. Acceptable Use & WhatsApp Anti-Spam Policy
Rules regarding automated follow-up messages and Meta WhatsApp compliance
FollowUpX is designed for ethical, consensual customer relationship management and quotation follow-ups. You explicitly agree that you will NOT:
Zero Unsolicited Cold Spam
Send unsolicited promotional broadcasts to individuals who have not inquired about your products or provided prior opt-in consent.
Compliance with Meta WhatsApp Commerce Policy
Transmit illegal goods, deceptive financial schemes, hate speech, gambling, or copyright-infringing catalog materials.
Violation of WhatsApp Business Terms or excessive spam reporting may result in instant suspension of your FollowUpX automation capabilities without refund.
3. Subscriptions, Fees & Billing
Payment cycles, plan renewals, taxes, and upgrades
FollowUpX offers starter tiers, professional monthly/annual subscriptions, and lifetime access options:
- Billing Currency: All prices are displayed in Indian Rupees (₹ INR) plus applicable Goods and Services Tax (GST).
- Payment Gateway: Payments are processed via authorized third-party PCI-compliant gateways (Razorpay, UPI, Net Banking, Credit/Debit Cards).
- Auto-Renewal: Subscription plans automatically renew unless cancelled before the renewal date through the Billing settings.
4. AI Message Generation & Merchant Review
Role of artificial intelligence in crafting sales drafts
Our smart AI persona generates suggested message drafts based on your store name, product catalog, and chosen tone (friendly, professional, urgent). While our models strive for high conversion, you retain ultimate responsibility for reviewing prices, delivery estimates, and quotation accuracy before sending messages to clients.
5. Limitation of Liability & Governing Law
Warranties, liability limits, and legal jurisdiction
To the maximum extent permitted by Indian law, FollowUpX shall not be liable for indirect, incidental, or consequential damages resulting from third-party network outages (such as WhatsApp server downtime or telecommunication failures). Our cumulative liability is limited to the total subscription fees paid by you in the 3 months preceding the claim.
Jurisdiction:
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra.
